Learn About Divorce Filing in Arizona

Understanding Arizona Divorce Laws and Requirements

Arizona has specific laws that govern how divorces are filed and processed. The state follows community property rules, meaning most property and debts acquired during the marriage are split equally between both spouses. Understanding these foundational rules helps you know what to expect throughout the divorce process.

To file for divorce in Arizona, you must meet certain residency requirements. At least one spouse must have lived in Arizona for a minimum of 90 days before filing. Additionally, the couple must have been married in Arizona, or if married elsewhere, at least one spouse must have lived in the state for 90 days. This requirement exists to ensure Arizona courts have proper jurisdiction over the case.

Arizona recognizes two types of divorce: contested and uncontested. In an uncontested divorce, both spouses agree on major issues like property division, child custody, and support arrangements. This type typically moves faster and costs less. A contested divorce occurs when spouses disagree on one or more significant matters, requiring the court to make decisions for them. According to Arizona court statistics, approximately 60-70% of divorces are resolved without going to trial, often through negotiation or mediation.

The state also requires a waiting period. After filing divorce papers, there is a mandatory 60-day waiting period before the divorce can be finalized. This period allows time for both parties to reconsider or work toward settlement. During this time, either spouse can still change their mind and dismiss the case.

Arizona courts consider various factors when making decisions about property division and custody. The state prioritizes the best interests of any children involved. For property division, courts look at contributions of each spouse to the marriage, the duration of the marriage, and the economic circumstances of each party at the time of divorce.

Practical takeaway: Before filing, verify that you or your spouse meet the 90-day residency requirement, and understand whether your divorce will likely be contested or uncontested. This helps you prepare for the timeline and costs involved.

The Divorce Filing Process Step-by-Step

Filing for divorce in Arizona begins with completing specific legal documents and submitting them to the appropriate county court. The process involves several steps that must be followed in order for your case to be valid.

The first step is completing the Petition for Dissolution of Marriage, which is the main document that starts the divorce case. This petition includes basic information such as your name, your spouse's name, the date of marriage, and information about any children. Arizona courts provide forms that you can use, available through the Arizona Supreme Court website or your local superior court. The petition must clearly state the grounds for divorce. Arizona is a no-fault divorce state, meaning you do not need to prove wrongdoing. You simply state that the marriage is "irretrievably broken."

Next, you must file this petition with the superior court in the county where you or your spouse live. There are filing fees required. As of 2024, the filing fee for a divorce petition in Arizona is approximately $300-$350, though fees may vary slightly by county. Some counties offer fee waivers for those who cannot pay. You will need to provide proof of your residency and the residency of your spouse when you file.

After filing, you must serve your spouse with the divorce papers. "Service" means officially delivering the documents to your spouse so they are legally notified of the divorce. You cannot simply hand the papers to your spouse yourself; a third party must deliver them. This can be done by a process server, a sheriff's deputy, or any adult who is not involved in the case. Your spouse then has 20 days to respond by filing an Answer to your petition.

If your spouse does not respond within 20 days, you may be able to proceed with a default divorce, where the court grants the divorce based on your petition without your spouse's input. However, if your spouse files an Answer, the case becomes active, and both parties can make claims about property division, custody, and support.

Practical takeaway: Start by obtaining the correct court forms for your county, gather required documentation about residency and assets, and budget for filing fees. Plan for the service process by understanding who can serve your spouse and how long it takes.

Property Division and Asset Distribution in Arizona

Arizona's community property laws have a significant impact on how assets and debts are divided in a divorce. Understanding these rules helps you know what property you may keep and what will be split with your spouse.

Community property refers to assets and debts acquired during the marriage by either spouse. Under Arizona law, community property is divided equally (50/50) between the spouses. This includes income earned during the marriage, real estate purchased during the marriage, vehicles acquired during the marriage, retirement accounts funded during the marriage, and debts accumulated during the marriage such as credit card balances or mortgages.

Separate property, by contrast, belongs entirely to one spouse and is not divided. Separate property includes assets owned before the marriage, inheritances received during the marriage (unless commingled with community property), gifts received from third parties during the marriage, and property that was explicitly agreed in writing to remain separate. For example, if you owned a home before marriage, that home is generally considered separate property. However, if both spouses made mortgage payments from community funds during the marriage, the home's value increase may be partially community property.

The division process can be straightforward if spouses agree on how to split assets, or complex if they disagree. In an uncontested divorce, spouses can negotiate which assets each person receives. They might agree that one spouse keeps the family home while the other keeps retirement accounts of equal value. In a contested divorce, the judge will divide property based on several factors including the length of the marriage, contributions of each spouse (including homemaking), and the economic circumstances of each party after divorce.

Arizona courts also consider business interests, professional licenses, and future earning potential when dividing property. If one spouse earned a professional license during the marriage (such as a medical or law degree), the value of that license may be considered community property. Similarly, if spouses built a business together during the marriage, that business is typically divided or valued and offset against other assets.

Debts are also divided as community property. Debts incurred during the marriage are the responsibility of both spouses, even if only one spouse's name appears on the account. However, debts incurred before marriage or after separation are generally not divided.

Practical takeaway: Make a detailed list of all assets and debts acquired during your marriage versus before it. Understanding what is community versus separate property helps you negotiate a fair settlement or prepare for court proceedings.

Child Custody and Support Determinations

When children are involved in a divorce, Arizona courts focus on what arrangement serves the best interests of the child. The state has developed clear guidelines for custody decisions and child support calculations.

Arizona recognizes two types of custody: legal custody and physical custody. Legal custody refers to the right to make major decisions about the child's upbringing, including decisions about education, healthcare, religious upbringing, and discipline. Physical custody refers to where the child lives and who provides day-to-day care. In many cases, courts award joint legal custody, meaning both parents share decision-making authority. Physical custody may be awarded to one parent (sole custody) or shared between both parents (joint custody or shared custody).

When determining custody arrangements, Arizona courts consider several factors: the wishes of the child (especially if the child is older), the relationship between the child and each parent, the child's adjustment to their current school and community, the mental and physical health of all parties, and which parent is more likely to encourage contact with the other parent. The court also considers any history of domestic violence or child abuse. Arizona has a presumption favoring joint legal custody unless evidence shows this is not in the child's best interest.

Child support is calculated using Arizona's child support guidelines, which consider the gross income of both parents and the number of children. The guidelines provide a formula that courts typically follow unless circumstances warrant a departure. For example, if one parent has the child more than 146 days per year, the support calculation adjusts. As of 2024, the combined parental income cap for the basic calculation is $250,000, though support can be calculated above this amount in high-income cases.

Child support covers basic living expenses, healthcare, and childcare costs. The paying parent (usually the parent with higher income or less parenting time) provides support to the custodial parent. Support continues until the child turns 18 or graduates from high school, which
