California Firearm Purchase Laws: An Overview of State Requirements

California maintains some of the most comprehensive firearm regulations in the United States. Understanding the basic framework of these laws is essential for anyone considering a firearm purchase in the state. California law divides firearms into several categories, each with specific rules governing their sale, transfer, and ownership. These categories include handguns, rifles, shotguns, and other regulated weapons. The state also maintains a unique system for tracking firearm transfers and ownership through licensed dealers.

The California Department of Justice oversees firearm regulations through the Bureau of Firearms. This agency maintains records of all firearm transfers and enforces state laws regarding who may and may not possess firearms. California law requires that all firearm purchases occur through licensed dealers, with very limited exceptions. Private sales of firearms are also regulated and must go through a licensed dealer for processing. This means that even if you know the person selling the firearm, the transaction must be completed by a licensed firearms dealer.

California's approach differs significantly from many other states. For example, while some states allow private parties to sell firearms directly to each other without any government involvement, California requires dealer involvement in virtually all transfers. The state also maintains waiting periods between the point of sale and when a buyer can take possession of the firearm. These waiting periods serve as a cooling-off period and allow for background check processing.

The state categorizes firearms based on their physical characteristics and mechanisms. Semi-automatic rifles with certain features are classified differently than those without those features. Handguns must meet specific safety requirements established by the state. Understanding these categories matters because the rules for purchasing, possessing, and transferring firearms depend on which category a particular firearm falls into.

Practical Takeaway: Before starting any firearm purchase process, learn which category your firearm of interest falls under. Categories determine waiting periods, registration requirements, and other legal requirements. Contact a local licensed firearms dealer or the California Department of Justice website for clarification on specific firearm classifications.

Background Checks and the California Firearm Purchase Process

Every firearm purchase in California requires a background check. When you attempt to purchase a firearm from a licensed dealer, the dealer submits your information to the California Department of Justice and the Federal Bureau of Investigation for background investigation. This process is designed to prevent firearms from reaching individuals who are prohibited from possessing them under state or federal law. The background check examines criminal history, mental health records, restraining orders, and other relevant information.

California law specifies categories of individuals who are prohibited from possessing firearms. These include people convicted of certain felonies, those subject to domestic violence restraining orders, individuals adjudicated as mentally incompetent, and those committed to mental health facilities. Additionally, people convicted of certain misdemeanors—particularly those involving violence, drugs, or threats—cannot possess firearms. Federal law adds additional prohibited categories, including people convicted of federal crimes and those subject to federal protective orders.

The background check process in California typically takes 10 days. This waiting period is mandatory under California law and applies to all firearm purchases, including purchases by individuals who already own firearms. During this 10-day period, the dealer cannot release the firearm to you. After 10 days, if no problems are found during the background check, the dealer may transfer the firearm to you. If the Department of Justice denies the transfer, the dealer will notify you of the denial and you may have the opportunity to contest the decision through a legal process.

The background check system used in California is more extensive than the federal background check system (NICS). California maintains its own database of prohibited individuals and requires checking against this state database in addition to federal databases. This state-level checking has identified individuals prohibited under state law but not federal law. California also requires dealers to check applicants against the state's database of people subject to gun violence restraining orders, a relatively recent development in firearm regulation.

Importantly, background checks are performed each time a firearm is transferred, not just once when someone first purchases a firearm. If you own a firearm and want to transfer it to a family member, even as a gift, the recipient must undergo a background check through a licensed dealer. There are narrow exceptions for transfers between spouses or domestic partners, but these exceptions still require registration with the state.

Practical Takeaway: Budget at least 10 days between your firearm purchase decision and the point when you can take possession. This waiting period is not discretionary and applies to all purchases. Use this time to complete any safety training courses that interest you and review local storage requirements.

Understanding California's Waiting Periods and Mandatory Hold Times

California enforces one of the longest mandatory waiting periods for firearm purchases in the nation. The standard waiting period is 10 business days, which means the dealer cannot transfer a firearm to you until 10 business days have passed since you submitted your background check application. This period applies regardless of whether you already own firearms, whether the background check is completed before the 10 days elapse, or whether you have prior training. The waiting period exists as a state policy designed to allow time for background checks and to provide a reflection period for purchasers.

The 10-day waiting period begins when you complete your firearm purchase application (called a "4473" form for federal purposes and additional state forms for California). The dealer submits your information to the Department of Justice on the same day or the next business day. The clock starts when the application is submitted, not when you decide to make the purchase. Some dealers may have their own internal waiting period before they even submit your application, so discussing the timeline with your dealer is important.

Weekend days and holidays do count toward the 10-day period, but the transfer cannot occur on days when the licensed dealer is closed. For example, if you submit your application on a Friday, the 10 business days includes the following week's business days. If a weekend or holiday falls during this period, those days still count toward your 10-day waiting period, but you cannot complete the transfer until the dealer is open for business after the period ends.

There are no exceptions to California's 10-day waiting period for any category of purchaser. Law enforcement officers, security professionals, military members, and others who might be exempt in some states are not exempt from California's waiting period. Active duty military members stationed in California and purchasing a firearm for lawful purposes do not have an exception. This uniform application of the waiting period applies to all purchasers.

California law also requires that after completing your background check and waiting period, you must take possession of the firearm from the dealer within 30 days of the background check approval. If you do not pick up the firearm within 30 days, the dealer must return the firearm to the manufacturer or destroy it in some cases, depending on the specific circumstances. This means you need to plan ahead and ensure you can collect your firearm within this window.

Practical Takeaway: When planning a firearm purchase, add 10 business days plus travel time to your schedule. If you are buying from a dealer far from your location, factor in time to complete the entire transaction including the mandatory waiting period. Mark your 10-day mark on a calendar and plan to pick up your firearm shortly after the waiting period ends to avoid the 30-day limit for taking possession.

Firearm Registration, Permits, and Licensing Requirements in California

California requires registration of certain firearms with the state. When you purchase a handgun, that handgun must be registered in your name with the California Department of Justice. The licensed dealer typically handles this registration as part of the purchase process and sends the registration information to the DOJ electronically. For handguns purchased from a dealer, registration occurs automatically through the dealer reporting system. The registration contains your information and details about the specific firearm, including its manufacturer, model, and serial number.

Rifles and shotguns purchased after January 1, 2018, must also be registered with the state. Prior to this date, California did not require registration of rifles and shotguns, but recent law changes expanded the registration requirement. When you purchase a rifle or shotgun from a licensed dealer after this date, the dealer will file a registration form with the Department of Justice. This registration process occurs as part of the standard dealer paperwork and background check process.

California does not issue firearm ownership licenses or permits to ordinary citizens for lawful firearm ownership. You do not need a special license to own a firearm in California if you are not prohibited. However, California does require permits for certain activities related to firearms. For example, if you want to carry a firearm in public (either openly or concealed), you need a permit from
